By accessing or using the AI chatbot (“Kink Assistant”) provided by REGULATION (GB) Ltd (“we,” “us,” or “our”), you (“you” or “Customer”) agree to be bound by the following Terms of Service. If you do not agree to these terms, you must not use the Service.
1. Service Description
This chatbot provides general product information, support, and advice related to our store's offerings, including adult products and generalised kink-related queries. It may also offer general suggestions or insights based on customer input.
This Service does not provide medical, psychological, or legal advice. All information should be considered informational only and not a substitute for professional consultation.
2. Use of OpenAI Services
The chatbot is powered by OpenAI’s language models. Your interactions with the chatbot (“Input”) are processed by OpenAI’s infrastructure. By using this Service, you agree to OpenAI’s Business Terms, including the following Content Sharing Agreement:
Content Sharing Agreement
This Content Sharing Agreement is between OpenAI, L.L.C. (“us” or “we”) and you (“Customer”). This Content Sharing Agreement is incorporated into the terms located at https://openai.com/policies/business-terms unless the parties have negotiated a separate agreement for the Services, in which case such agreement will govern (the “Business Terms”). Capitalized terms not defined here are defined in the Business Terms or the Data Processing Agreement between the parties in connection with the Services (the “DPA”). This Content Sharing Agreement takes precedence in the event of any conflict.
Notwithstanding anything set forth in the Business Terms, we may use Customer Content that is designated by your organization owner in your account (“Designated Content”) to develop and improve the Services, including for training our models and other research, development, evaluation, and testing purposes (“Development Purposes”). You expressly agree that use of Designated Content for the Development Purposes is not subject to the provisions of the DPA nor is it subject to the security measures, auditing, or other obligations applicable to Customer Content that is not Designated Content for the Development Purposes. OpenAI will process such Designated Content for Development Purposes as an independent Data Controller. You are responsible for all Input provided by you and your End Users.
You also represent and warrant that you have the rights, licenses, and permissions necessary – including as applicable that you have provided any notice to End Users, and collected any relevant consent from End Users (“Notice”) – to provide the Input to the Services for the Development Purposes. You agree that you and your End Users will not provide any information as Input to the Services that you or your End Users do not want to be used for Development Purposes, such as sensitive, confidential, or proprietary information. You also agree that you will not use the Services to process (a) any data that includes or constitutes “Protected Health Information,” as defined under the HIPAA Privacy Rule (45 C.F.R. Section 160.103), or (b) any Personal Data of children under 13 or the applicable age of digital consent. You also agree that you will provide OpenAI a copy of your Notice upon OpenAI's request.
3. Anonymous Chat Log Viewing
To improve the chatbot’s relevance and accuracy:
- Some anonymised chat logs may be reviewed by our team for refinement purposes.
- No personal identifying information is stored or reviewed.
- By using the Service, you consent to this review process.
4. User Conduct
You agree not to use the chatbot to submit:
- Any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable material;
- Any personal information of persons under 18;
- Health information, financial account information, or other sensitive data.
We reserve the right to block users who violate these terms.
5. Privacy
Please refer to our Privacy Policy for how we collect, use, and store your data. By using the Service, you consent to our data practices.
6. Limitation of Liability
This Service is provided “as is” without warranties of any kind. We disclaim all liability for any direct or indirect damages arising from the use or inability to use the Service.
7. Changes to These Terms
We may update these Terms at any time. Continued use of the Service after changes means you accept the new terms.
